Rule 36
Accepting an auction or re-auction sale
(1) The tender or sealed invoice submitted in accordance with Rule 35 shall be opened at the place and time mentioned in the same notice, and the relevant customs officer shall prepare a comparative statement of the bid amount or, in case the postage has been increased by open bidding, prepare the same.
(2) According to sub-rule (1) the acceptance score of the person who accepts the minimum value or more amount on the basis of comparative statement or installments shall be accepted. If there is more than one person who bids more than the minimum price, the bid of the highest bidder must be accepted.
(3) According to sub-rule (2), after acceptance of the acceptance number, the auctioneer shall be notified within seven days to pay the remaining amount and pick up the goods.
(4) If the remaining amount is not paid and the goods are not picked up within the time limit as per sub-rule (3), then his bond will be confiscated and the second, third or fourth buyer's receipt number may be accepted respectively. In this way, if the auction cannot be sold even after accepting the buyer's receipt, the deposit will have to be confiscated and re-auctioned.
(5) If there is a need to re-auction according to sub-rule (4), when publishing the notice of bid, sealed bid or bidding for the second time, the notice can be published by giving a deadline of seven days.
(6) Even after publishing the notice for the second time according to sub-rule (5), if no one comes to the auction at the minimum price, the committee according to rule 54 shall re-evaluate and maintain the revised minimum price and publish the notice according to rule 35 and increase the auction. If the auction cannot be increased even with the re-evaluated price, the customs officer can sell it directly at the Rohwar of the representative of the concerned district administration office and treasury and accounting controller office.

(10) Notwithstanding anything written elsewhere in this regulation, when auctioning goods that can only be sold with a license in accordance with the prevailing law, the sale shall be made only to a person who has such a license.
(11) Notwithstanding anything written elsewhere in this regulation, if National Tadding Limited, Salt Tadding Corporation, Saha Bhandar Ltd., Tara Village Development Committee or a cooperative society wants to purchase the goods to be auctioned from the customs, it shall be negotiated not less than the minimum price fixed in accordance with this regulation. (12) Notwithstanding anything written elsewhere in this paragraph, the goods seized or confiscated in accordance with the Act or purchased in accordance with clause (b) of sub-section (15) of section 13 of the Act, perishable, perishable or become old and lose their value or their use-by date is more than three months.
